"The Ultimate" Gazillion Bubbles Photo Contest Official Rules
NO PURCHASE NECESSARY TO ENTER OR WIN. A purchase or payment of any kind will not increase your chances of winning.
The 2015 "The Ultimate" Gazillion Bubbles Photo Contest (the "Contest") begins at 9:01 a.m. Pacific Time ("PT") on March 20, 2015 and ends at 11:59 p.m. PT on July 20, 2015 (the "Contest Term"). This is a skill-based contest. The public will be invited to vote for their favorites among eligible entries posted on the Contest web site. Each month a panel of judges will select one winner by applying the Judging Criteria from the ten entries receiving the most votes during the immediately preceding calendar month. At the end of the Contest Term the judges will select one winner by applying the Judging Criteria from the twenty entries receiving the most votes during the Contest Term. Each photograph entered may only win one monthly prize. By submitting an entry, each entrant agrees to the Official Rules and warrants that his or her entry complies with all requirements set out in these Official Rules.
Contest is open only to individuals who are at least 18 years old who have reached the age of majority in their jurisdiction of residence at the time of entry, who reside in the fifty (50) United States, the District of Columbia, Canada (excluding Quebec), Great Britain, Australia, New Zealand and Mexico and who did not purchase any equipment or Gazillion products for the purpose of entering this Contest. CONTEST IS VOID IN QUEBEC AND WHERE PROHIBITED. Contest is not open to employees of Funrise, Inc., ("Sponsor") or their subsidiaries and affiliates, and their immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they live) and persons living in the same households of such employees, whether or not related, are not eligible.
HOW TO ENTER:
Each Entry consists of an entry form and a single digital photo file featuring Gazillion Bubbles. You must complete the standard registration form with your name and e-mail address, which will be used to contact you should your photo win. There is no limit on entries per person/email address/household during the Contest Term. Once an entry wins a monthly prize it is not eligible for future monthly prizes although it will remain eligible for the grand prize. All entries become the property of Sponsor.
ENTRY PHOTO CONTENT RESTRICTIONS:
- The photo must not contain material that violates or infringes anyone’s rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement;
- The photo must not disparage Sponsor, its brands or products or any other person or party affiliated with the Promotion;
- The photo must not contain brands, brand names or trademarks other than those owned by or licensed to the Sponsor;
- The photo must be original and must not contain images or artwork not created by entrant, other than images or artwork owned by or licensed to Sponsor;
- The photo must not contain material that is, in Sponsor’s judgment in the exercise of its sole discretion, inappropriate, indecent, vulgar, hateful, tortious, defamatory, slanderous or libelous;
- The photo must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; and
- The photo must not contain material the creation of which involved the violation of, or which violates, the laws or regulations of the state or province in which the photo was created.
Photos depicting competitive bubble products will not be accepted and/or considered for Contest. NO PURCHASE NECESSARY. The purchase of any product or service will not increase an eligible entrant’s chances of winning.
One (1) photo per month for five months (April – July 2015) will win a prize, and one Grand Prize winner will be chosen at the end of the Contest and announced July 2015.
By participating, entrants agree to be bound by these Official Rules and the decisions of the judges and/or Sponsor, which are binding and final on all matters relating to the Contest. Contest is subject to all applicable federal, provincial, state and local laws.
Once photographs are submitted and deemed eligible for voting by the Sponsor, they are eligible for the Voting Phase. The Voting Phase shall be open throughout the Contest Term and votes may be cast at any time. During the Voting Phase, photos deemed eligible by the Sponsor will be posted in the Gazillion Bubbles contest gallery for public voting. The general public will be invited to vote for their favorite photo. The votes shall be tabulated by Sponsor on or about the twenty-third day following the ends of each calendar month. Limit: Each person may vote one (1) time per day, per photo during the Voting Phase. Votes received from any person or IP address in excess of the stated number will be void. Entrants are prohibited from obtaining votes by any means which are, in the sole judgment of the Sponsor, fraudulent or inappropriate, including, without limitation, offering prizes or other inducements in exchange for votes. The Sponsor reserves the right to verify the validity and originality of any entry and/or entrant (including an entrant's identity and address) and to disqualify any entrant who submits an entry that is not in accordance with these Official Rules or who tampers with the entry process. Failure by the Sponsor to enforce any of its rights at any stage does not constitute a waiver of those rights. The ten (10) eligible entries receiving the highest number of valid votes during the preceding calendar month will be deemed the finalists whose photos will be voted upon by the judges during the Judging Phase to determine a monthly prize winner. Potential contest winners will be notified by mail, email or phone 7-10 days after the winning photo has been selected and may be required to execute and return an affidavit of eligibility (or, if a resident of Canada, a declaration of eligibility), a liability release and, where lawful, a publicity release within seven (7) days of date of issuance. If such documents are not returned fully-executed within the specified time period, a prize/prize notification is returned as undeliverable, or a potential winner is not in compliance with these rules, the prize will be forfeited and an alternate winner will be selected by the Judges based on the Judging Criteria. In the event that the selected winner of any prize is/are ineligible, cannot be traced or does not respond within ten (10) days to a winner notification as required by the "Contest Prizes" Rules above, or refuses the prize, the prize will be forfeited and Sponsor, in its sole discretion, will choose to award the prize to an alternate entrant.
In case of a tie, the entrant whose photo received the higher score for the Creativity category during the Judging Phase will be deemed the potential winner.
Within thirty days following the end of each month the ten photographs receiving the largest number of votes during the preceding calendar month will be submitted to a panel of qualified judges selected by Sponsor who will evaluate each eligible photo in order to determine a monthly prize winner. The judges shall utilize the following criteria in determining a winner ("Judging Criteria"): (1) Creativity – 34% (2) Photographic quality – 33%, (3) Composition 33%.
In the event of a tie, the tied entries will be re-submitted to the Judges for a re-judging between the tied entries alone. In the event that a tie remains after re-judging, the entry with the highest score in the Creativity criterion will be declared the winner. Decisions of the judges are final and binding.
Monthly Prizes: The monthly prize winner will be selected from among the ten photographs receiving the highest number of votes during the prior calendar month. Those ten photographs will be selected for the Judgment Phase and a monthly prize winner determined by the Judges based on the Judging Criteria. The Monthly prize will be a $150 Toys “R” Us® Gift Card and one hundred dollars ($100) suggested retail value of Gazillion Bubbles product and merchandise.
One (1) winner per month (April, May, June, July 2015) will be chosen. Limit one (1) prize per person per month during the Contest Term. A winning photograph is only eligible for one monthly prize. Value: $250.
One (1) Contest Grand Prize: $500 Toys "R" Us® gift card and one hundred dollars ($100) suggested retail value of Gazillion Bubbles product and merchandise.
Within thirty days following the end of the Contest Term, one (1) Grand Prize winner will be chosen from the twenty photographs with the total highest overall votes. Those twenty photographs will be selected for the Judging Phase and a grand prize winner determined by the judges based on the Judging Criteria. The winner of the grand prize will be announced following the end of the Contest Term.
Prizes are awarded as is, with no warranty or guarantee, either expressed or implied by Sponsor. Winner may not substitute, assign or transfer prize or redeem prize for cash, but Sponsor reserves the right, at its sole discretion, to substitute for a prize (or portion thereof) a prize of comparable or greater value. Winner is responsible for all federal, state, provincial and local taxes (including income and withholding taxes), if any, as well as any other costs and expenses associated with acceptance and use of a prize not specified herein as being awarded. All prize details are at Sponsor's sole discretion. Neither Toys "R" Us® nor any of its affiliates is a sponsor of this Contest or involved in the administration of this Contest.
By entering the Contest, all entrants grant an irrevocable, perpetual, worldwide non-exclusive license to Sponsor, to reproduce, distribute, display and create derivative works of the entries (along with a name credit) in connection with the Contest and promotion of the Contest, in any media now or hereafter known. Entrants consent to the Sponsor doing or omitted to do any act that would otherwise infringe the entrant’s “moral rights” in their entries. Display or publication of any entry on Sponsor’s website does not indicate the entrant will be selected as a winner. Sponsor will not be required to pay any additional consideration or seek any additional approval in connection with such use. Additionally, by entering, each entrant grants to Sponsor the unrestricted right to use all statements made in connection with the Contest, and pictures or likenesses of Contest entrants, or choose not to do so, at their sole discretion. Sponsor will not be required to pay any additional consideration or seek any additional approval in connection with such use.
LIMITATION OF LIABILITY:
By entering this Contest, all entrants agree to release, discharge, and hold harmless Facebook, Sponsor and its partners, their affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in this Contest or any Contest-related activities and the acceptance and use, misuse, or possession of any prize awarded hereunder.
Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to Contest entries or entry forms; or alteration of entries or entry forms. Sponsor is not responsible for any problems with or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email entry to be received on account of technical problems or traffic congestion on the Internet or at any website, human errors of any kind, or any combination thereof, including any injury or damage to entrants' or any other persons' computers related to or resulting from participation, uploading or downloading of any materials related to in this Contest.
Entrant acknowledges that the promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. By entering this Contest, entrant is providing information to Sponsor and not to Facebook.
Persons who tamper with or abuse any aspect of the Contest, as solely determined by Sponsor, will be disqualified. Should any portion of the Contest be, in Sponsor's sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Contest and, if terminated, at its discretion, select the potential winners from all eligible, non-suspect entries received prior to action taken.
Each winner by acceptance of prize, except where legally prohibited, grants permission for Sponsor and its designees to use his/her name, address (city and state/province), photograph, voice and/or other likeness and prize information for advertising, trade and promotional purposes without further compensation, in all media now known or hereafter discovered, worldwide, and on the Internet and world wide web, in perpetuity, without notice or review or approval. In the event of a dispute regarding entries received from multiple users having the same e-mail account, the authorized subscriber of the e-mail account at the time of entry will be deemed to be the entrant and must comply with these rules. Authorized account subscriber is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses.
